Terms of Service

1. Acceptance of Terms

By accessing or using the Selekt Audio platform (“Service”), including our sample library, marketplace, community challenges, and AI-powered audio analysis tools, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Selekt Audio.

2. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to the following:

• You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent.
• You must provide accurate, current, and complete information during registration and keep your account information up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify Selekt Audio immediately of any unauthorized use of your account.

3. Sample Library License

All samples in the Selekt Audio library are sourced from public domain recordings and Creative Commons licensed sources. This includes sound recordings published before 1926 in the United States, recordings released under Creative Commons Zero (CC0), and recordings released under Creative Commons Attribution (CC-BY) licenses. By accessing the sample library, you are granted a perpetual, non-exclusive, worldwide license to use these samples in your music productions, including commercial releases. For samples licensed under CC-BY, you are required to provide appropriate credit to the original artist as specified in your download certificate. Your download certificate for each sample states the exact license terms and any attribution requirements — you are responsible for complying with these terms.

Selekt Audio does not claim ownership of public domain content. The samples may be used in any genre, on any platform, and in any media format without royalty obligations or clearance fees. This license applies to samples downloaded or streamed through the Service. Multiple users may use the same sample — all licenses are non-exclusive.

Jurisdiction Notice. Public domain status is determined under United States copyright law. Copyright terms vary by country. If you are located outside the United States, you are responsible for verifying that a recording is in the public domain in your jurisdiction before commercial use. Selekt Audio does not guarantee public domain status in all territories.

Content Verification. Every sample added to the Selekt Audio library is screened against a database of over 150 million commercially released recordings using audio fingerprinting technology prior to inclusion. Samples that show any commercial distribution signals — including record label ownership, distributor affiliations, ISRC/UPC registration, or presence on streaming platforms — are rejected. While Selekt Audio takes reasonable measures to verify the public domain or Creative Commons status of all content, no automated system in the industry can guarantee 100% accuracy. This applies equally to all platforms, regardless of size. Selekt Audio does not guarantee that every sample is free from all possible copyright claims worldwide. By downloading or using any sample from the library, you acknowledge that you are solely responsible for independently verifying the copyright status and clearance of any recording before commercial use in your jurisdiction. Your download certificate documents the source, license type, and screening results at the time of issuance.

AI Analysis Accuracy. Metadata provided for each sample — including BPM, musical key, genre, mood, instrument classification, and section boundaries — is generated by automated AI analysis and may not be 100% accurate. This data is provided as a convenience and should be independently verified for critical or professional use cases.

Stem Separation. AI-generated stems (vocals, drums, bass, other) derived from public domain samples inherit the same public domain status as the source recording. Stems are provided for creative use and may contain artifacts inherent to the separation process.

Download Limits. Free tier accounts are limited to 5 sample downloads per month. Pro tier accounts receive unlimited downloads. Download limits reset on the first day of each billing cycle.

4. User-Generated Content

You retain full ownership of any original content you create, including beats, compositions, and sample packs. By uploading content to the Selekt Audio marketplace or participating in community challenges, you grant Selekt Audio a non-exclusive, royalty-free license to display, distribute, and promote your content within the platform.

You represent and warrant that:

• You own or have all necessary rights to the content you upload.
• Your content does not infringe on the intellectual property rights of any third party.
• You will not upload copyrighted material that you do not have authorization to distribute.

Selekt Audio reserves the right to remove any content that violates these Terms or applicable law.

5. Marketplace Terms

The Selekt Audio Marketplace allows Pro tier users to buy and sell beats, sample packs, and other audio content. The following terms apply to marketplace transactions:

• Sellers set their own prices and define their own license terms for each listing. Selekt Audio does not determine pricing or license structure.
• Selekt Audio charges a platform fee on each completed transaction. The current fee schedule is available on the pricing page.
• Sellers warrant that they have full rights to sell the content they list and that their listings do not infringe any third-party rights.
• Buyers receive a license to use purchased content as specified by the seller's listing terms. All sales are between the buyer and seller; Selekt Audio acts as a facilitator.
• Listings built entirely from Selekt Audio library samples receive a “Verified Cleared” badge automatically. Listings using outside material require the seller to attest that all content is original or properly cleared.
• All marketplace listings are reviewed before going live. Selekt Audio reserves the right to reject or remove listings that violate these Terms.

6. Challenge Submissions

Selekt Audio hosts community beat-making challenges where producers submit original works (“flips”) created using a designated source sample. By submitting to a challenge:

• You retain ownership of your submission. You grant Selekt Audio a non-exclusive license to feature, promote, and display your submission on the platform, in marketing materials, and on social media.
• Submissions must use the designated source sample and comply with any rules specified for that challenge.
• Voting is open to authenticated users. Each user may vote once per submission. Vote manipulation (including use of multiple accounts) is prohibited and may result in disqualification and account suspension.
• Winners are determined by community vote count at the time the challenge ends. Selekt Audio reserves the right to disqualify submissions that violate challenge rules.

7. Community Sample Submissions

Users may submit public domain recordings to expand the Selekt Audio library. By submitting a sample, you represent and warrant that the recording is in the public domain and free from copyright restrictions. All submissions are reviewed by Selekt Audio before being added to the library. Accepted submissions credit the contributor on their public profile.

8. Copyright & DMCA Policy

Selekt Audio respects the intellectual property rights of others. If you believe that content on the platform infringes your copyright, you may submit a DMCA takedown notice to dmca@selektaudio.com with the following information:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the material on the platform that you claim is infringing, with enough detail for us to locate it.
• Your contact information (name, address, phone number, email).
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material and notify the uploader. Repeat infringers will have their accounts terminated.

9. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any applicable law or regulation.
• Redistributing raw, unmodified samples from the Selekt Audio library as your own sample pack or sound library.
• Using automated tools, bots, scrapers, or crawlers to access, extract, or download content from the Service.
• Attempting to interfere with, compromise, or disrupt the Service or its infrastructure.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
• Harassing, abusing, or threatening other users of the platform.

10. Intellectual Property

The Selekt Audio brand, logo, user interface, design, and AI models are the intellectual property of Selekt Audio and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the platform's proprietary technology without prior written consent.

Public domain samples available through the Service are not claimed as Selekt Audio's intellectual property. Original content created by users remains the property of its respective creators, subject to the licenses granted in these Terms.

11. Payment & Billing

Subscriptions. Selekt Pro is available at $9.99 per month or $7.99 per month when billed annually. Subscriptions automatically renew at the end of each billing period unless you cancel. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period, and you will retain Pro access until then.

Payment Processing. All payments — including subscriptions and marketplace transactions — are processed by third-party payment processors (such as Stripe, PayPal, and/or Gumroad). By making a purchase, you agree to the applicable payment processor's terms of service. Selekt Audio does not store your credit card number or full payment credentials. All payment information is handled directly by our payment processors.

Refund Policy. Due to the nature of digital content, all sales of downloadable samples, beats, and sample packs are final and non-refundable once the content has been downloaded or streamed. Pro subscription fees are non-refundable for partial billing periods. Exceptions may be made at Selekt Audio's sole discretion or as required by applicable law.

Marketplace Payouts. Sellers receive payouts for completed marketplace sales via the payment processor. Selekt Audio deducts the applicable platform fee before disbursement. Payouts are subject to minimum thresholds and processing schedules determined by the payment processor. Sellers are responsible for any applicable taxes on their earnings.

Failed Payments. If a subscription payment fails, we will attempt to process the payment again. If payment cannot be collected after a reasonable grace period, your account will be downgraded to the free tier.

Chargebacks. If a buyer initiates a chargeback or payment dispute for a marketplace purchase, Selekt Audio reserves the right to suspend the buyer's account pending resolution. Sellers may be required to provide evidence that the transaction was legitimate.

Currency. All prices on the platform are displayed and charged in United States Dollars (USD).

12. Termination

Selekt Audio reserves the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that is harmful to the platform, other users, or third parties. Upon termination, your right to access the Service will cease immediately.

You may delete your account at any time through your account settings. Upon deletion, your profile and associated data will be removed in accordance with our Privacy Policy. Any content you have sold on the marketplace may remain available to buyers who have already purchased it.

13. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Copyright Screening. Selekt Audio employs audio fingerprinting technology to screen every sample against a database of over 150 million commercially released recordings before inclusion in our library. This screening checks for record label ownership, distributor affiliations, ISRC/UPC registration, and presence on major streaming platforms. This is the same class of acoustic recognition technology used across the music industry by platforms such as Shazam, Deezer SongCatcher, and Musixmatch. However, no automated copyright detection system — regardless of the platform or company operating it — can guarantee 100% accuracy. Selekt Audio does not warrant or guarantee that any sample in the library is free from all possible copyright claims worldwide. Download certificates reflect the results of our screening process at the time of issuance and do not constitute legal advice. Users are solely responsible for independently verifying rights and clearance in their jurisdiction before any commercial use.

No Legal Advice. Nothing on this platform — including download certificates, license labels, source attributions, or screening results — constitutes legal advice or a legal opinion. If you require legal certainty about the copyright status of a recording, you should consult a qualified attorney in your jurisdiction.

Selekt Audio does not warrant that AI-powered audio analysis results, including BPM detection, key detection, instrument classification, or any other automated analysis, will be accurate, complete, or error-free. AI analysis is provided as a convenience and should be verified independently for critical use cases.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Selekt Audio and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the theory of liability.

In no event shall Selekt Audio's total aggregate liability exceed the amount you have paid to Selekt Audio in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

15. Changes to Terms

Selekt Audio reserves the right to modify these Terms at any time. When changes are made, we will update the “Last updated” date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
